
The Ten Circuit Court of Appeals has just ruled that the Ten Commandments monument on the courthouse lawn in Haskell County, Oklahoma is unconstitutional. Here's a summary:
We hold that under the unique circumstances presented here, the Establishment Clause was violated because the reasonable observer would rule the Monument as having the impermissible principal or primary effect of endorsing religion.Here's a link to a newsletter I wrote based on information in an opinion I wrote challenging the monument. The Apellate Court has reversed and remanded the decision of the U.S. District Court in Eastern Oklahoma that ruled the monument constitutional.

Bruce, my friend, we have prevailed! But I fear that Jim Green (and likely I)will bear the brunt of hate and vindictiveness for his courageous action in bringing this lawsuit. Profound thanks for your participation and contributions to the Jim's case! We'll have to wait and see how far their side will take any further legal actions. Jim Worsham, a current commissioner and the one who testified that the commissioner who hung on me "wouldn't have done that," is saying that they won't take it down. I was just in town earler this morning (Tues.) and someone was setting up to photograph or video the monument. Look at the news tonight and I bet there'll be something about it.
